Article 1 - Applicability of general terms and conditions
These general terms and conditions apply to all quotations, agreements, and resulting arrangements relating to services offered and products delivered by Coated Surfaces. By commissioning Coated Surfaces, the client agrees to these terms. Deviations from or additions to these terms are only valid if agreed upon in writing or by e-mail with Coated Surfaces. All offers and quotations from Coated Surfaces are non-binding.
Article 2 - Warranties and defects
Coated Surfaces guarantees the quality of its products and warrants that they are suitable for their intended use. Floors carry a warranty period of 3 years, including liquid resistance, unless otherwise agreed in writing. The warranty period commences upon full completion of the floor or wall. A warranty claim is only valid if all payment obligations have been met. Any defects must be reported to Coated Surfaces in writing or by e-mail within 14 days of completion.
The warranty does not cover cracking or veining caused by structural movement, subsidence, or building settlement, wear from normal use, moisture problems in the substrate or leaks not attributable to Coated Surfaces, and defects resulting from subfloors not installed by Coated Surfaces.
If a defect falls within the warranty, Coated Surfaces will repair or replace at its own discretion. The client must follow all instructions and recommendations from Coated Surfaces. Warranty claims must be submitted in writing as completely and clearly as possible.
Article 3 - Offers, quotations, and prices
Quotations are valid until the expiry date stated therein. All prices are in euros and include 21% VAT, unless otherwise agreed. For homes older than two years, the reduced VAT rate of 9% may apply. Quotations are based on substrates that meet the requirements described in these terms and the Coated Surfaces checklist. Additional or reduced work is not included in the quotation and will be discussed during the site visit, approximately 3 weeks before commencement. The final invoice reflects the actual square metres completed. Coated Surfaces applies tiered pricing per m2. Changes in surface area may result in an adjusted price per m2, either upward or downward.
Article 4 - Colours, compositions, and execution
Colour samples serve as an indication only. Variations may occur due to manual application and natural materials. Irregularities in the substrate remain visible in the final result. During execution, slight marks, structural differences, or contamination such as dust or insects may become visible. Despite protective coatings, discolouration may occur due to sunlight, use, or maintenance. Skirting boards should preferably be finished after completion due to slight undulation of the floor. Wall finishes are applied by hand and naturally exhibit slight structural differences. Concrete-look floors are mixed on site; the appearance may vary between rooms and floor sections. Following the maintenance instructions is essential. The finish is not resistant to acids, abrasives, and colourants.
Article 4.1 - Deviations between colour samples and final result
Our floors are handcrafted using natural raw materials. This makes every floor unique. Deviations from colour samples are inherent to the product and do not constitute grounds for complaint.
Article 4.2 - Colour deviations during repair
Visible colour or structural differences may occur during repair work due to ageing, light exposure, or batch differences. This is inherent to the product and unavoidable.
Article 4.3 - Maintenance obligations of the client
The client receives a maintenance protocol upon completion. Following this protocol is a condition for a valid warranty claim. Damage resulting from improper maintenance falls outside the warranty. This applies in particular to the use of acids, abrasives, colourants, and steam cleaners. These substances and methods damage the finish and void the warranty.
Article 5 - Preparation by the client
Before commencement of work, the client ensures that the space is empty, clean, safe, and draught-free, with adequate lighting. Changes to colour or scheduling must be communicated at least 3 weeks before the planned start date. If a change is reported less than 3 weeks before commencement, Coated Surfaces will charge 750 euros per week. The floor or wall must not be subjected to light use for at least 72 hours after completion. Full use is only permitted after 28 days. During the first 4 weeks, no standing water is allowed on the floor.
Article 6 - Substrate requirements
Coated Surfaces measures the moisture level in advance. Without a moisture barrier, the maximum permissible residual moisture is 2.5%. When an epoxy primer is applied as a moisture barrier, residual moisture may rise to a maximum of 4 to 6%, depending on the substrate and situation. Exceeding these limits may result in voiding of the warranty or postponement at additional cost. Specific requirements apply to concrete, cement-bound, anhydrite, and wooden substrates. In wet areas, the installation of sanitary skirting and sealant is mandatory for a valid warranty. If this is not followed, the warranty for moisture penetration in that area is voided.
Article 7 - Engagement of third parties
If it benefits the final result, both the client and Coated Surfaces may engage third parties.
Article 8 - Additional and reduced work
Additional or reduced work must be recorded in writing. Settlement takes place at the final invoice, unless otherwise agreed.
Article 9 - Force majeure and unforeseen circumstances
In case of delay due to unforeseen circumstances, this must be reported at least 5 days in advance. Late notification may result in a charge of 350 euros per additional day.
Article 10 - Completion and approval
Completion dates are indicative and not absolute deadlines. Upon completion, Coated Surfaces photographs the condition of the floor or wall. The client is deemed to have accepted the final result unless defects are reported in writing within 14 days.
Article 11 - Cancellation and suspension
Up to 6 weeks before start: free of charge. Cancellation 4 to 6 weeks before start: 15% of the quotation value. Cancellation 3 to 4 weeks before start: 30% of the quotation value. Cancellation within 3 weeks before start: 50% of the quotation value.
Article 12 - Payment terms
Work only commences after receipt of the first instalment. Coated Surfaces always applies a payment schedule in two instalments: 50% in advance and 50% upon completion. Invoices must be paid within 14 days of the invoice date. In case of late payment, the statutory commercial interest rate is owed from the due date. Collection costs amount to a minimum of 450 euros.
Article 13 - Liability
Coated Surfaces is only liable for damage caused by its own actions. Consequential damage is excluded. Liability is limited to the invoice amount of the assignment.
Article 14 - Applicable law and disputes
All agreements are governed by Dutch law. Disputes are preferably submitted to the Bedrijfschap Afbouw (Dutch Building Finishing Trade Board). If necessary, disputes are settled by the competent court.
